Payment Terms & Retainer Policy

• Orders over $500: A 50% non-refundable retainer is required to secure your order. The remaining 50% must be paid 30 days before the event date.

• Orders under $500: Full payment is required unless otherwise specified. Some offerings may be available with less than 30 days’ notice; those specific orders must be paid within 72 hours.

• Long-Term Bookings & Orders:

  • 25% non-refundable retainer if booked more than 9 months in advance

  • 50% of total due by 6 months before event

  • 100% of total balance due 30 days before event

  • All retainers are non-refundable and non-negotiable

Payment Confirmation: Once your retainer or full payment is received, a confirmation message and invoice will be sent.

Late Payment & Rush Fee Policy

• Late payments incur a 30% rush fee on the total order amount.

• Orders with outstanding balances will not be prepared, released, or delivered until full payment (including rush fee) is received.

• Late or incomplete payments may result in order cancellation, with no refund of prior retainers.

No Refunds Policy

• All payments and retainers are final and non-refundable.

• Applies to acts of God, weather events, cancellations, transportation delays, or other unforeseen circumstances.

• All sales are final after deadlines and full payment, including retainers.

Rescheduling Policy

• Standard orders: must request reschedule at least 7 days prior

• Large orders, private events, and gatherings: minimum of 14 business days prior

• Requests subject to availability and may incur fees.

• Failure to reschedule within timeframes results in forfeiture of the order.

Expedited Orders & Delivery Surcharges

• Expedited orders must be communicated directly to Whirlwind Creations.

• Delivery is not included; fees based on mileage start at $20 for the first 10 miles.

• Travel to other states may include additional fees: room & board, rental vehicles, flights, etc., client’s responsibility.

Force Majeure & Event Disruption

• Whirlwind Creations is not liable for delays or cancellations due to:

  • Severe weather, natural disasters, or acts of God

  • Government restrictions or emergencies

  • Supply chain or labor disruptions

  • Illness, pandemics, or public health emergencies

  • Venue cancellations or client no-shows

• We may reschedule or cancel orders without refund consistent with the No Refunds Policy.

Food Handling & Liability

• All orders prepared by certified food handlers.

• Clients must disclose all allergies; Whirlwind Creations, its owners, employees, and family members are not responsible for allergic reactions.

• Not responsible for spills, accidents, or damage after pickup or delivery.

• Best consumed same day; refrigeration overnight acceptable, some ingredients may lose quality.

Customization Policy

• Custom orders incur an additional fee starting at $25.

• Images are for inspiration; final products may vary.

• Clients may purchase boards, risers, linens, etc., if not specified at booking, provided notice is given 48 hours to 7 business days prior.

Missing or Damaged Items

• Rental equipment must be returned clean and damage-free within 48 hours.

• Missing or damaged items: $50 per item; late returns: $100 fee.

• Any missing/damaged item on delivery or pickup: $40 per item fee.

Photography & Media Release

• Whirlwind Creations may take photos/videos and post on social media, website, emails, flyers, etc.

• Clients agree to this, but may request faces or minors be excluded with written permission.

Privacy Policy

• Client data is handled in accordance with Whirlwind Creations’ privacy policy.

• By using our services, clients consent to data collection and usage as outlined in the policy.

Governing Law

• All agreements are governed by laws of all 50 U.S. states.

Arbitration Agreement

• Disputes shall be resolved via binding arbitration according to the American Arbitration Association rules.

• Arbitration occurs in the state where the service was provided or agreed upon.

Client Responsibility

• Clients are responsible for reading all Terms & Conditions and Privacy Policy.

• By contacting Whirlwind Creations, clients agree to all terms for all orders, inquiries, quotes, bookings, and payments.

• Clients accept full responsibility for any failure to ask questions or understand terms.

Right to Refuse Service

• Whirlwind Creations may refuse service at any time for any reason.

• Formal written notice will be sent via email.

• All orders adhere to a written contract.

• If law enforcement is required for safety, involved parties may be blacklisted and charges may be pressed.

• Contracts may be canceled at any time due to harm, intimidation, or unsafe behavior.

Limitation of Liability

• Whirlwind Creations is not liable for indirect, incidental, or consequential damages, except in cases of gross negligence or willful misconduct.

Indemnification

• Clients agree to indemnify, defend, and hold harmless Whirlwind Creations, its owners, employees, and affiliates from any claims, damages, or expenses arising from client actions, negligence, or failure to disclose relevant information.

Severability

• If any provision is invalid or unenforceable, the remaining provisions remain in full effect.

Entire Agreement & Amendments

• This document constitutes the entire agreement between client and Whirlwind Creations.

• Any modifications must be in writing and agreed to by both parties.

Electronic Communications & Notices

• Emails, texts, and digital invoices are legally binding communications between client and Whirlwind Creations.

Insurance Disclaimer

• Whirlwind Creations carries general liability insurance.

• Clients are responsible for property damage or injuries at private venues unrelated to our direct services.
